Website Hosting, Terms of Service

1. Acceptance of Terms

By ordering, paying for, or using any service from Lynx Digital Marketing Inc. (“we,” “us,” “our”), you (“you,” “Customer”) agree to be bound by these Terms of Service (“ToS”). If you do not agree, do not use our services.

2. Service Description 

We provide unmanaged shared web hosting, reseller hosting, and VPS services located exclusively in Canada (“Services”). 

We do not provide any maintenance, management, support, monitoring, backups, software updates, security patching, or troubleshooting beyond what is explicitly stated in this document.

You are fully responsible for the content, security, and operation of your hosting account from the moment it is provisioned.

Regarding website transfers between hosting providers: When canceling hosting or changing hosting providers, Website host transfers are required to be completed within 30 days of service expiry or cancelation. Additional transfer fee will be required. If a new host is not transferred to within the 30 day grace period, hosting from Lynx Digital Marketing will be shut down and website data will be removed from the Lynx servers.

3. Extremely Limited Support

– Support is provided exclusively via email system. 

– We will not answer “how-to” questions about your website, scripts, CMS (WordPress, etc.), email setup, databases, or code. 

– We will only assist with issues that are verifiably caused by our infrastructure (e.g., server completely offline, cPanel/WHM not loading). 

– Any ticket asking for assistance outside of server-level issues will be closed without response.

4. Account Provisioning & Acceptance

Your hosting account is considered delivered and accepted the moment login credentials are emailed to you. 

No refunds are available after provisioning, even if you cannot figure out how to use the service.

5. Payment

– All fees are prepaid in Canadian dollars (CAD). 

– Services auto-renew unless canceled in writing 15 days before renewal. 

– No refunds or prorated credits for early termination or non-use.

6. Acceptable Use Policy (AUP)

You may not use the Service for: 

– Anything illegal under Canadian federal or provincial law. 

– Unsolicited bulk email (spam) – zero tolerance; immediate termination without refund. 

– Open proxies, mail relays, or Tor exit nodes. 

– Cryptocurrency mining. 

– Child sexual abuse material (CSAM) or any content that violates Canadian law. 

Violation = immediate termination without warning or refund and possible referral to law enforcement or the RCMP.

7. No Uptime Guarantee / No SLA

We make no guarantee of uptime or performance. Outages caused by hardware failure, network issues, DDoS attacks, overselling, or scheduled maintenance are your problem. No credits or refunds will be issued.

8. Resource Usage (Shared & Reseller Hosting)

– Accounts that consistently degrade server performance may be suspended or terminated without warning. 

– We do not publish specific CPU/memory/disk I/O limits because we reserve the right to change them at any time.

9. Backups

We perform periodic server-level backups for disaster-recovery purposes only. 

These backups are not guaranteed and are not available to customers. 

You are solely responsible for your own backups. We are not liable for data loss under any circumstances.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: 

– Our total liability is limited to the amount you paid us in the previous 3 months. 

– We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data loss.

11. Termination

We may suspend or terminate your account immediately and without notice for any reason, including: 

– Non-payment 

– AUP violation 

– Excessive support requests 

– If we simply decide we no longer wish to host you 

Upon termination, all data will be deleted immediately and irreversibly.

12. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada. Exclusive venue is Edmonton, Alberta.

13. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance.

14. Entire Agreement

This is the entire agreement between you and Lynx Digital Marketing Inc. There are no verbal agreements or promises of support beyond what is written here.

By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms with no expectation of hand-holding, managed services, or proactive maintenance of any kind.
